  • Merhaba arkadaşlar , Boğaziçi üniversitesin uluslararası ticaret bölümnde okumaktayım fakat hukuk dersimiz var ve uzaktan yakından pek alakam yoktur dersle. Şöyle bi case verdi hoca 2 tane;

    1. Photographer Mrs. Photolover shot a photograph of her daughters while they were playing on the beach. She included that photograph in her exhibition and sold it for use in greeting cards. Two years later, Beautyinthekitchen, ahome decoration compnay came across with these cards and decided to use those cards as the images of the summer collection. The company did only small changes in the colours. Beautyinthekitchen sold this collection and made a significant profit. Upon discovering the copy, Mrs. Photolover sued , Beautyinthekitchen for copyright infringement. Please give advice to the Mrs. Photolover in writing the allegations and on the possible outcome of the case.



    2 . Canned cat food is but the latest product in the food sector to fall to the growing scrutiny of a possible cartel. An ongoing investigation revealed that four producers had become involved in a strategy of mutual benefit, a so called ‘non-aggression pact’, whereby they worked together to coordinate prices and share customers. They had aimed to safeguard their companies against an unexpected drop in prices that could have lead to serious financial issues to their business and industry.

    Please indicate the legal implications of this pact by referring to the competition law.
